This user agreement is concluded between the administration of JobBro, and individuals and legal entities that use or intend to use the website: www.jobbro.org and / or the JobBro application, hereinafter referred to as the User or Potential User.

 

Please read this User Agreement, as well as other documents posted in the User section of the website: www.jobbro.org and / or in the JobBro application before using them.

 

By completing the registration on the website: www.jobbro.org and / or downloading the JobBro application and completing the registration in it and using them, you are considered to have read the terms of the documents posted in the User section of these resources, and agreed to accept and comply with the terms of these documents, in particular, this User Agreement, in its entirety. Your use of the website: www.jobbro.org and/or the JobBro app signifies your agreement to be bound by the terms and conditions incl. of this User Agreement.

1. DEFINITION

1.1. This User Agreement, hereinafter referred to as the User Agreement, contains the following terms, which, within the limits of this User Agreement, will have the following definitions:

1) User Agreement is an Agreement, a document that defines the terms of interaction when using the website: www.jobbro.org and / or the JobBro application, the terms of which are mandatory for the use of these resources (except for information that is open to persons (Potential Users ) without their registration). In addition, the User Agreement, in particular, refers to documents, in particular, the privacy policy, as well as other applications that are its integral part of this User Agreement, directly defined in such applications.

2) Parties to the User Agreement - the administration of JobBro and the User (Potential User - within the terms of the Potential User);

3) JobBro Administration - a person who ensures the operation of the www.jobbro.org website and / or the JobBro application, and is also the copyright holder of the information, content posted on the website / application, respectively. The text of the User Agreement may be referred to as "We", "Us".

4) Website - software, the copyright of which is the Administration of JobBro, access to which is possible at the link: www.jobbro.org.

5) JobBro Application - software owned by the JobBro Administration, access to which is possible when downloaded by the User or Potential User.

6) Resources - when jointly referred to as the Website and the JobBro application.

7) Potential User – a natural and/or legal person visiting the Website and/or the JobBro App, or a person likely intending to use the Website and/or the JobBro App in full, but has not yet completed registration or a person using the services provided by the Resources to persons without their registration.

8) User - an individual and / or legal entity that can use the Resources in accordance with the law, who has read and accepted and agreed to the terms of the User Agreement, agreed to their full implementation and completed registration on the Website and / or in the application Job Bro. The Users include persons who are looking for a job (User Candidate), persons, in particular posting vacancies on the Resources (User Employer), other persons who can use the services of the Resources in accordance with the User Agreement. The text of the User Agreement may be referred to as "you", "you".

9) Personal account - the User's personal page on the Website and/or the JobBro Application, which can be accessed using, in particular, a phone number and a password, which provides the User with additional opportunities to use resources.

10) Services - any services available to Users of the Website and/or JobBro Application.

11) Privacy Policy - a document that defines the conditions for collection, processing, storage, use, etc. personal information of the Users received by the Administration using the Users, Potential Users of the Resources and is an integral part of the User Agreement. 12) Forum - an option of the Resources that allows Users to exchange messages, and Potential Users to view messages exchanged by Users on the forum.

1.2. All other terms and definitions that appear in the text of the User Agreement are interpreted by the Parties in accordance with the legislation of the Republic of Poland, and if certain terms and definitions are not covered by it, then the usual rules for interpreting the relevant terms and definitions prevailing on the Internet apply.

1.3. The titles of the headings of the User Agreement are intended solely for the convenience of using the text of the User Agreement and have no legal significance for the interpretation of individual terms and definitions.

 

2. POTENTIAL USER

2.1. The potential user, as a person wishing to use any of the resources, is aware of and agrees that:

1) The User is responsible for compliance with the terms of this User Agreement, as well as the requirements of the legislation of the state of his residence and / or the state from which the User gets access to the use of any of the resources;

2) If the User Agreement mentions different conditions for different categories of persons, in particular, those who intend or use any of the Resources (Potential Users and Users) or among the Users themselves (which may be, in particular, due to the location of the Users), The user independently determines which conditions apply to him, and is also responsible for the use of any of the resources;

3) By agreeing to the terms of the User Agreement, agrees to comply, in addition to the terms of the User Agreement, also the terms of the Privacy Policy, as well as other applications that are an integral part of the User Agreement.

2.2. The Potential User and the User undertake:

1) not to mislead the JobBro Administration and Users, including by providing false information, including about yourself, not to report false, inaccurate, incomplete information;

2) reliably and promptly report information related to the use of any of the Resources, if such information is requested by representatives of the JobBro Administration, from the terms of this User Agreement;

3) not to use any of the Resources for the purpose of carrying out any illegal activity, including, but not limited to, fraud, blackmail, and / or other illegal actions, and also not to provide any auxiliary actions to assist another User in the production of any illegal activities, including but not limited to the above;

4) if there are grounds to believe that another User has carried out, is being carried out or will be committed any illegal activity, unlawful actions, the User undertakes to inform the representatives of the JobBro Administration all the information known to him;

5) not violate the intellectual property rights (copyrights, patent rights, trademark rights and other intellectual property rights) of the JobBro Administration;

6) not distribute unsolicited or unauthorized informational or advertising materials, any letters with unsolicited mail, spam, etc., including when using the Forum;

7) not get access to any source code, basic ideas and concepts and algorithms of operation of any of the Resources;

8) not to take actions that in any way may adversely affect the operation of any of the Resources, in particular, but not exclusively, to upload to the Website and / or to the JobBro Application any materials containing viruses, Trojans, any other malicious programs, perform other actions that will (may) lead to negative consequences for the functioning of any of the Resources;

9) not to carry out unauthorized access to any of the Resources, Personal Accounts of other Users, etc.

2.3. When registering, the potential user (candidate user) in particular guarantees:

1) that he has entered (will enter) reliable and up-to-date information, including name, surname, telephone number, password;

2) a person of 18 or more years of age (or at another age from which he has full legal capacity) and is a person capable of using any of the Resources, subject to the terms of this User Agreement and the laws of the state of which he (she) is a citizen;

3) is familiar with the User Agreement, and in case of agreement to comply with its terms in full, incl. applications, which are an integral part of it, affixes a corresponding mark in the registration form provided by the Website and/or the JobBro Application.*

2.4. When registering, the potential user (User-Employer), in particular, guarantees:

1) is a registered business entity (individual entrepreneur or legal entity) entitled to carry out employment activities in accordance with the requirements of the law, incl. . post vacancies, etc.;

2) that he has entered (will enter) reliable and up-to-date information, including name, surname/name, telephone number, password; when providing a logo, trademark, etc. when using any of the Resources, the User-Employer grants the JobBro Administration permission to use it within the framework of the functions of any of the Resources;

3) carrying out activities legally, legally and providing information, incl. when posting vacancies that correspond to reality, it is reliable, truthful;

4) providing access to the Personal Account exclusively to authorized persons of the User-Employer;

5) make payments in accordance with the User Agreement, applications that are its integral part, other documents, policies, etc.

*If you as a potential user do not accept and agree to the terms of this Agreement, you may not use the Website and/or the JobBro App. In such case, the Website and/or the JobBro Application shall be deemed unavailable to you.

2.5. When registering, the User, in particular, specifies the phone number and password. A code is sent to the phone specified during registration by the JobBro Administration, which the User must enter in the appropriate field in the Resource where the User registers in order to complete such registration.

2.6. From the moment of receiving an information message about successful registration, granting the User access to the Personal Account, the registration of the User on the relevant Resource is considered completed, the person who has registered from that moment acquires the status of the User, for which the terms of this User Agreement, incl. concerning the User are obligatory.

2.7. As long as you agree to and comply with the terms of this User Agreement, you, as a User, are granted a personal, non-transferable, limited right to access your Personal Account, provide the Services available on the Website and / or in the JobBro App.

 

3. PERSONAL AREA

3.1. Upon successful registration, the User is granted access to the Personal Account, which, in particular, contains information about the User.

3.2. The User is obliged to ensure the safety of the password and other data specified during registration to third parties, while the User independently determines the procedure for storing the specified information and takes measures to prevent access to them by third parties.

3.3. When changing the data specified by the User during registration, the User undertakes to update them as soon as possible from the moment the relevant information is changed, to make appropriate changes regarding such information in the Personal Account.

3.4. The password can be changed by the User at any time after registration in any of the Resources.

3.5. In case of loss or access by third parties to the password information, other information specified by the User during registration, the User is obliged to immediately inform the Website Support Service and / or the JobBro Application by sending a corresponding message to the Support Service: [email protected] , for the Website and/or JobBro App Support to take appropriate action.

3.6. By the time such a message is received, all actions performed using the User's Personal Account will be considered performed by the User himself.

3.7. The creation and use by one User of two or more Personal Accounts is not allowed and is considered as a violation of this User Agreement, which entails the immediate suspension of all specified Personal Accounts, as well as the suspension of all actions related to the specified Personal Accounts

3.8. The User who is looking for a job (User Candidate) undertakes to use any of the Resources solely for personal use (without the purpose of carrying out entrepreneurial activities).

3.9. If there is reason to believe that with the help of the User's Personal Account, including the User who is in search of candidates (User-Employer), other Users are carrying out suspicious activities and / or illegal activities, the JobBro Administration may request additional information from the User, which the User undertakes to provide by filling out the appropriate form in your Personal Account or send it to the email address of the Support Service: [email protected].

Until the completion of the request provided for in this subparagraph, the User's right to access the Personal Account may be terminated.

3.10. The User, at his own discretion, may close his Personal Account on the Website and / or in the JobBro Application at any time.

3.11. For good reasons, the JobBro Administration may restrict or suspend access to the Personal Account of the Website and/or the JobBro Application.

 

4. HOW TO USE RESOURCES

4.1. Before using the Resources, the User is obliged to read, in addition to the User Agreement itself, the annexes that are its integral part, other documents posted in the Resources in the order in which the relevant Services are provided.

4.2. The user-candidate uses any of the resources to search for a job, draw up documents necessary for the user-candidate for employment and track the stages of their registration, and communicate directly with a potential employer (user-employer).

4.3. The User-Employer uses any of the Resources to post information about vacancies, search for potential candidates and provide information for potential candidates (User-Candidate), etc.

4.4. The User-Employer agrees and confirms that in case of employment of the User-Candidate and his work for a period of 14 (fourteen) or more calendar days on the vacancy of the User-Employer posted on any of the Resources, the User-Employer must pay the Administration the amount determined by the relevant policy from the respective bank account. The moment of the beginning of determining the term for starting the work of the User-candidate for a certain vacancy of the User-employer is determined in accordance with the information of one of the Resources, with the help of which such employment took place.

 

5. RIGHTS AND LIMITATIONS OF LIABILITY

5.1. In the case of the provision / receipt of Services by Users, the Parties understand that one Party is the Candidate User, and the other is the Employer User, namely, the above persons are the Parties when performing these actions, unless otherwise specified. The User understands and agrees that any of the Resources, the JobBro Administration is not a Party in the specified legal relationship, the JobBro Administration does not provide such Services. The JobBro Administration, in turn, is a person who exclusively provides Users, both Candidate Users and Employer Users, with software.

The JobBro Administration takes measures to ensure the validity of the use of any of the Resources, however, the JobBro Administration cannot guarantee the completeness, veracity, and reliability of information on Users (both on Candidate Users and on Employer Users, including on premises) by them vacancies).

5.2. The User, using the capabilities of any of the Resources, at his own risk receiving the Services, access to which is provided using any of the Resources, understands that the Resources are provided "as is", and in the form in which they are available to you and the User independently is responsible for its actions, including in case of failure to meet any expectations of the Users, incurring losses, etc. Any of the Resources, the JobBro Administration cannot guarantee the User that the Services will meet the User's expectations, as well as that the Users will fulfill their obligations towards other Users.

5.3. The user understands that legal regulation is not always unambiguous, and may be accompanied by significant changes, which may also affect the market for employment relations. By agreeing to the User Agreement, the User agrees that any of the Resources, the JobBro Administration is not responsible for the application of certain provisions of the law, incl. when the User-employer provides and / or receives the Services by the Candidate User using any Resource, the JobBro Administration.

5.4. Problems in the functioning of any of the Resources in exceptional cases may create certain difficulties in the provision / receipt of Services by the Parties, which may be due to overloading of any of the Resources, technical difficulties in maintaining the operability of any of the Resources, technical capabilities of Users' devices on the Internet, etc., which may cause interruptions, delays in functioning and the User agrees with the consequences that may be due to the above risks.

5.5. The User understands that there may be other risks associated with the use of any of the "Resources" that were not specified in this User Agreement, and also guarantees that he waives any claims against the JobBro Administration and / or any - which of the Resources in the event of negative consequences through no fault of the JobBro Administration and / or any of the Resources.

5.6. Users understand that the JobBro Administration and / or any of the Resources does not act in the interests of the User, does not act as an agent or adviser in relation to any Services provided on any of the Resources.

5.7. The user, using the capabilities of any of the resources at his own peril and risk, incl. when providing / receiving the Services, undertakes to independently bear responsibility, in particular, but not limited to: for its actions and / or inaction in the framework of the use of any of the Resources, including for direct or indirect losses, lost profits, loss of income, loss of data , or expenses incurred as a result of the User's use of any of the Resources, etc.; when storing any information provided through any of the resources, including, but not limited to, login, password, email address, etc.

5.8. The JobBro Administration has the right, at its own discretion, without giving reasons, to refuse to provide access to any of the Resources to any Potential User, as well as in the cases specified in this User Agreement, its annexes, as well as to suspend the provision of access to the User to any of the Resources, about than the User is notified to the phone / e-mail address specified by him when registering on any Resource.

The JobBro Administration cannot be held liable for any actions, direct or indirect losses, lost profits, loss of income, any expenses, expenses of the User resulting from the use by the User of any of the Resources, in particular, when providing / receiving Services, access to which provided by any of the resources.

5.9. The JobBro administration cannot guarantee continuous access to any of the resources, including in the event of force majeure. The JobBro Administration is not responsible for the provision / receipt of the Services, access to which is provided to any Resources, properly for the occurrence of any errors, delays, failures, inconsistencies, and also if the Service cannot be provided, completed. Force majeure events are, in particular, natural phenomena, fires, strikes, civil unrest, power outages, power failures, the issuance of relevant legislation, Internet failures, acts of terrorism, software malfunction, security breach or cyber attacks.

5.10. The JobBro administration takes various measures to ensure the storage of data provided by Users. At the same time, the JobBro Administration cannot guarantee the complete security of the data provided by the Users when third parties gain access to the Users' data directly from the Users themselves or due to improper measures taken by the Users themselves to save their data.

5.11. The JobBro Administration cannot guarantee the integrity of other Users provided by the Services. The JobBro administration cannot guarantee the integrity of external sites that the User can access through any of the resources. The User, by going to external and third-party sites, links to which the User received using any of the resources, independently bears all the risks associated with the use of such sites. In this regard, the JobBro Administration informs about the need for prudent use of such sites. In the event of a transition to external and third-party sites accessed by the User through any of the Resources, the JobBro Administration recommends that you familiarize yourself with the terms, rules, agreements of the above sites in order to make sure that there is no threat to the User when using these sites.

5.12. The user understands that:

1) any of the Resources is provided to the User on an "as is" basis;

2) The JobBro Administration has the right to temporarily suspend the operation of any of the Resources, both with and without notice to the User, at its own discretion, in the event of maintenance work (only during maintenance work), force majeure, or in other cases provided for in the User Agreement or Annexes thereto;

3) The JobBro Administration has the right, at its own discretion, to suspend access to the Personal Account, in the event of technical problems caused by a software failure or other technical problems in the operation of any of the Resources, errors in the operation of the Personal Account - in this case, after these factors are settled, the JobBro Administration uses measures to restore the work of the User's Personal Account;

4) the performance of the provision / receipt of services, access to which is provided by any of the Resources, depends on many factors, in connection with which the JobBro Administration cannot answer and cannot guarantee the performance of these actions in the conditions and terms desired by the User, and also cannot guarantee the achievement the result that the User was counting on, since the JobBro Administration is not a Party within the framework of the relationship for the provision of Services, but provides an opportunity by way of derogation to the software for the Parties for such legal relations.

5) The JobBro Administration adheres to the policy of non-interference in the provision / receipt by the Users of the Services, access to which is provided using any of the Resources, when providing / receiving the Services, the JobBro Administration does not provide the Users with any consultations, advice, recommendations. The JobBro administration can post information, news, disclose events, post articles of different authorship, but this is not a consultation, advice, recommendation for the User (Users). Any decisions in the provision / receipt of the Services, access to which is provided using any of the Resources, are unambiguous and definite decisions of each individual User, taken at his own discretion, for which the User is solely responsible.

 

6. PRIVACY POLICY

7. SETTLEMENT OF DISPUTES

7.1. Each of the Parties to the User Agreement has the right to present claims to the other Party.

7.2. In the event that the User has claims against the JobBro Administration and/or any of the Resources, the User shall submit a claim to the email address of the Support Service: [email protected].

7.3. If there are claims in the JobBro Administration against the User, the JobBro Administration sends a claim using the services to the mobile phone number or to the current email address of the User. Information about the existence of a specific claim may be contained in the user's personal account.

7.4. Upon receipt of a claim, the Party is obliged to respond to the claim later than 20 calendar days after its receipt.

7.5 Claims sent by e-mail of the Parties must be duplicated in writing to the legal and / or postal addresses of the Parties in order to ensure their proper receipt within 10 calendar days from the date of their sending by e-mail. In this case, the date of receipt of the claim is the date the sender of the claim received a message about reading the e-mail in which the claim is stated or attached.

7.6. If it is impossible to resolve the above disputes in a claim procedure, any disputes, disagreements or claims arising from and / or in connection with this User Agreement, the use of any of the Resources, are subject to final resolution by the court.

 

8. APPLICABLE LAW

8.1. This User Agreement is governed by and construed in accordance with the laws of the Republic of Poland.

 

9. INTELLECTUAL PROPERTY

9.1. Unless otherwise specified, all content presented on any of the resources is the intellectual property of the JobBro Administration and is protected by copyright and other means of protection and protection of intellectual property rights, while the commercial designations used may be protected as trademarks.

9.2. Software, text, image, graphics, data, materials, graphics, video and audio (hereinafter referred to as content) used on any of the resources are the intellectual property of the JobBro Administration.

9.3. You can view, use copies of content from any of the Resources solely for personal informational non-commercial use, provided that you keep all technical means of protection and signs of protection of these materials, comply with the terms of this User Agreement, its Appendix, as well as the provisions of the law.

9.4. Trademarks, logos of the JobBro Administration used by any of the Resources are the intellectual property of the JobBro Administration and / or copyright holders to whom the JobBro Administration has granted the appropriate rights. All rights reserved.

9.5. Compilation, distribution, modification, use of any content posted on any of the resources, partial use and processing of content and its placement on any other sites, other resources is prohibited without the prior written permission of the JobBro Administration to carry out such actions.

9.6. The JobBro Administration reserves the right to use all legal remedies against actions that violate the rights of the JobBro Administration regarding the protection and protection of copyright, other intellectual property rights.

9.7. If there are any assumptions to believe that the content posted on any of the Resources violates any and/or someone else's intellectual property rights, the User can contact the Support Service: [email protected].

9.8. By registering on any of the resources, the User agrees that any content posted on any of the resources is protected by intellectual property rights, including copyright. When using any of the resources, these rights are not transferred and do not pass to the user.

 

10. FORUM USE

10.1. The JobBro Administration may provide the User (Potential User) with the opportunity to use the Forum.

10.2. At the same time, when using the Forum, the User is prohibited from:

1) insult other Users, as well as representatives of the JobBro Administration (violation of this paragraph may restrict the User's access to the Forum);

2) use profanity;

3) be expressed in order to incite ethnic hatred, promote violence in any form, insult the religious feelings of other Users, etc.;

4) distribute links in any form;

5) advertise goods and services of third parties;

6) flood, spam, communicate on topics not related to employment and any Resource;

7) provide false or misleading information, including about the JobBro Administration and/or any of the Resources.

 

11. CHANGING THE TERMS OF THE AGREEMENT

11.1. The terms of this User Agreement and / or Applications may be unilaterally changed by the JobBro Administration without prior notice to the User. The new version of the User Agreement and/or its Annexes shall enter into force and be observed from the moment the new version of the User Agreement and/or its annexes is published.

11.2. The JobBro Administration announces the entry into force of a new version of the User Agreement and / or amended Annexes to it by posting their texts on any of the Resources.

11.3. Before each use of any of the Resources, provision or receipt of Services using the Resources, the User undertakes to familiarize himself with the terms of the current version of the User Agreement and its Annexes.

11.4. The JobBro Administration is not responsible for the fact that the User at any time was not familiarized (did not familiarize himself) with the current version of the User Agreement and / or amended Annexes to it.

11.5. The use of any of the Resources means the User's consent to the current version of the User Agreement at the time of using the Resources (or one of them).

11.6. If the User does not agree with the new version of the User Agreement and / or the amended Annexes to it, the User stops using the Resources.

11.7. This User Agreement cannot be changed by the User as a whole or in a separate part.

 

12. FINAL PROVISIONS

12.1. This User Agreement is valid and binding both for the JobBro Administration and for the User.

12.2. The implementation by the User of any actions on any of the Resources is a confirmation of the User's consent to comply in full with the User Agreement, other Applications that are integral parts of the User Agreement.

12.3. The headings and subheadings in this User Agreement are for the purpose of facilitating navigation only and should not be taken into account in interpreting any of the terms and conditions of this Agreement.

12.4. The User Agreement, as well as the Applications, which are integral parts of the User Agreement, were drawn up in Ukrainian. Despite the availability of translations of the above documents into other languages, in the event of a conflict between the Ukrainian version of the above documents and other translations into other languages, the Ukrainian version of these documents will take precedence.

12.5. If any of the terms of this User Agreement is held to be illegal, invalid, unenforceable, in whole or in part, by any court of competent jurisdiction, such term will not affect the legality, validity, performance of the other terms of this User Agreement in full.

12.6. In the event of any inconsistency between this User Agreement, Applications, other documents, pages of any of the Resources, the terms of this User Agreement will take precedence.
