USER AGREEMENT

This user agreement is concluded between the JobBro administration and individuals and legal entities that use or intend to use the website: www.jobbro.org and / or the JobBro application, hereinafter referred to as the User or Potential User.

 

Please read this user agreement, as well as other documents posted in the User section of the website: www.jobbro.org and / or the JobBro application before using them.

 

After completing the registration on the website: www.jobbro.org and / or By downloading the JobBro application and completing the registration and using it, you are considered to have read the terms of the documents posted in the User section of these resources and agreed to accept and comply with the terms of these documents, in particular this User Agreement, in full . Your use website: www.jobbro.org and / or the JobBro application means your consent to compliance, including of this User Agreement. 

 

1. DEFINITIONS

1.1. This User Agreement, hereinafter referred to as the User Agreement, contains the following terms, which within the framework of this User Agreement will have the following definitions:

1) User Agreement - this Agreement, a document defining the terms of interaction using the website: / or the JobBro application, the conditions of which are mandatory for the use of these resources (except for information that is open to persons (potential users) without their registration). In addition, the User Agreement, in particular, means documents, in particular, the privacy policy, as well as other annexes, which is an integral part of this User Agreement, which is directly defined in such annexes.

2) Parties to the User Agreement - the JobBro administration and the User (Potential User - within the terms of the Potential User);

3) JobBro Administration - a person who ensures the operation of the website www.jobbro.org and / or the JobBro application, as well as is the owner of the information, content posted on the website / application, respectively. According to the text of the User Agreement, it is possible to mention as "We", "Us".

4) Website - software owned by the JobBro Administration, which can be accessed at: www.jobbro.org.

5) JobBro Application - software owned by the JobBro Administration, which can be accessed by downloading by the User or Potential User.

6) Resources - by joint reference JobBro website and application.

7) Potential User - a natural and / or legal person who visits the Website and / or the JobBro Application, or a person who probably intended to use the Website and / or the JobBro Application in full, but has not yet completed the registration or a person who uses the services provided by the Resources to persons without their registration.

8) User - a natural and / or legal person who may use the Resources in accordance with the law, and who has read and accepted and agreed to the terms of the User Agreement has agreed to perform them in full and completed registration on the Website and / or in the application JobBro. Users include persons who are looking for work (User-candidate), persons who, in particular, place vacancies on the Resources (User-employer), other persons who may use the services of the Resources in accordance with the User Agreement. 9) Personal account - personal page of the User on the Website and / or JobBro Application, which can be accessed using, in particular, phone and password, which provides the User with additional opportunities to use the Resources.

10) Services - any services available to Users Website and / or JobBro Application.

11) Privacy Policy - a document that determines the conditions of collection, processing, storage, use, etc. of personal information of Users received by the Administration of JobBro use by Users, Potential Users of the Resources, and is an integral part of the User Agreement. 12) Forum - Resource option that allows Users to exchange messages, and Potential Users - to view messages exchanged by Users on the forum.

1.2. All other terms and definitions found in the text of the User Agreement are interpreted by the Parties in accordance with the legislation of the Republic of Poland, and if certain terms and definitions are not covered by it, then the usual rules of interpretation of relevant terms and definitions.

1.3. The titles of the User Agreement titles are intended solely for the convenience of using the text of the User Agreement and have no legal significance for the interpretation of certain terms and definitions.

 

2. POTENTIAL USER. USER

2.1. The potential user as a person wishing to use any of the Resources is aware of and agrees that:

1) The User is responsible for compliance with the terms of this User Agreement, as well as the laws of the country of residence and / or state from which the User receives access to use any of the Resources; 

2) In case of mention in the User Agreement of different conditions for different categories of persons, in particular, those who intend or use any of the Resources (Potential Users and Users) or directly among Users (which may be, in particular, location of Users) , The User independently determines what conditions apply to him, as well as is responsible for the use of any of the Resources;

3) By agreeing to the terms of the User Agreement, agrees to comply with, in addition to the terms of the User Agreement, also the terms of the Privacy Policy, as well as other applications that are an integral part of the User Agreement.

2.2. The Potential User and the User undertake:

1) not to mislead the Administration of JobBro and the Users, including by providing information that is inaccurate, including about themselves, not to report false, inaccurate, incomplete information;

2) accurately and promptly communicate information related to the use of any of the Resources, in the event of a request for such information by representatives of the JobBro Administration, based on the terms of this User Agreement;

3) not to use any of the Resources for the purpose of carrying out any illegal activity, including, but not limited to, fraud, blackmail, and / or other illegal actions, as well as not to provide any ancillary actions to assist another User in carrying out any illegal activity, including but not limited to the above;

4) if there are grounds to believe that another User has committed, is carrying out or will carry out any illegal activities, illegal actions, the User undertakes to inform the representatives of the JobBro Administration all the information known to him;

5) not to infringe the intellectual property rights (copyright, patent, trademark and other intellectual property rights) of the JobBro Administration;

6) not to distribute unsolicited or unauthorized information or advertising materials, any letters with spam, spam, etc., including when using the Forum;

7) not have access to any source code, basic ideas and concepts and algorithms of any of the Resources;

8) not to take actions that may in any way adversely affect the operation of any of the Resources, in particular, but not exclusively, upload to the Website and / or to the JobBro Supplement any materials containing viruses, Trojans , any other malicious programs, perform other actions that will cause (may cause) negative consequences for the functioning of any of the Resources;

9) not to carry out unauthorized access to any of the Resources, Personal Accounts of other Users, etc.

2.3. The potential user (Candidate User) during the registration, in particular, guarantees:

1) that he has entered (will make) reliable and up-to-date information, including name, surname, phone number, password;

2) who is a person aged 18 and over (or at another age from which he has acquired full legal capacity) and is a person capable of using any of the Resources, subject to the terms of this User Agreement and the law of the state of which he is a citizen ) is;

3) is acquainted with the User Agreement, and in case of agreement to comply with its terms in full, including of the application, which is an integral part of it, shall affix the appropriate mark in the registration form provided by the Website and / or the JobBro Supplement. *

2.4. The potential user (User-employer) when registering, in particular, guarantees:

1) is a registered business entity (individual entrepreneur or legal entity), which has the right to carry out employment activities in accordance with the law, including . to place vacancies, etc .;

2) that he has entered (will enter) reliable and up-to-date information, including name, surname / title, telephone, password, etc .; when providing a logo, trademark, etc. when using any of the Resources, the Employer User grants the JobBro Administration permission to use it within the functions of any of the Resources;

3) carrying out activities legally, legally and providing information, including when posting vacancies, which is true, is reliable, truthful;

4) granting access to the Personal Account exclusively to the authorized persons of the User-employer;

5) make payments in accordance with the User Agreement, annexes that are an integral part of it, other documents, policies, etc.

* If you, as a potential user, do not accept or agree to the terms of this Agreement, you may not use the Website and / or the JobBro Application. In this case, the Website and / or the JobBro Application is considered to be inaccessible to you.

2.5. When registering, the User, in particular, specifies the phone number and the desired password. The code specified by the User for registration by the JobBro Administration is sent, which the User must enter in the appropriate field in the Resource where the User registers in order to complete such registration.

2.6. From the moment of receiving the information message on successful registration, granting the User access to the Personal Account, registration of the User on the relevant Resource is considered completed, the person who has registered since then acquires the status of User for which the terms of this User Agreement relating to the User are mandatory.

2.7. As long as you agree to and comply with the terms of this User Agreement, you, as the User, are granted a personal, non-transferable, limited right of access to the Personal Account, provision of Services available on the Website and / or the JobBro Supplement.

 

3. PERSONAL OFFICE 

3.1. Upon successful registration, the User is given access to the Personal Account, which, in particular, contains information about the User.

3.2. The User is obliged to ensure the preservation of the password and other data specified during registration to third parties, while the User independently determines the order of preservation of this information and takes measures to prevent access to them by third parties.

3.3. When changing the data specified by the User during registration, the User undertakes to update them as soon as possible from the moment of changing the relevant information, to make appropriate changes to such information in the Personal Account.

3.4. The password can be changed by the User at any time after registration in any of the Resources.

3.5. In case of loss or in case of third parties access to password information, other information provided by the User during registration, the User is obliged to immediately notify the Support Service of the Website and / or JobBro Application by sending a message to the Support Service : [email protected], to take appropriate action by Website Support and / or the JobBro Supplement.

3.6. Until such a notification is received, all actions performed using the User's Personal Account will be considered committed by the User.

3.7. The creation and use of two or more Personal Accounts by one User is not allowed and is considered a violation of this User Agreement, which entails the immediate suspension of all specified Personal Accounts, as well as the suspension of all actions related to these Personal Accounts

3.8. The user who is looking for work (User-candidate) undertakes to use any of the Resources exclusively for personal use (without the purpose of doing business).

3.9. If there are grounds to believe that suspicious activity and / or illegal activity is carried out with the help of the User's Personal Account, including the User who is looking for candidates (Employer-Employer), other Users, the JobBro Administration may request additional information from the User. The User agrees to provide the appropriate form in his / her Personal Account or send it to the Support Service e-mail address: [email protected].

Until the completion of the request provided for in this sub-clause, the User's right of access to the Personal Account may be terminated.

3.10. The User may, at his / her discretion, close his / her Personal Account on the Website and / or in the JobBro Application at any time.

3.11. If there are good reasons, the JobBro Administration may restrict, suspend access to the Personal Account of the Website and / or the JobBro Supplement.

 

5. PROCEDURE FOR USE OF RESOURCES

  1. Before using the Resources, the User is obliged to read, in addition to the User Agreement, applications, which are an integral part of it, other documents posted in the Resources on the procedure for providing relevant Services.

5.2. The Candidate User uses any of the Resources for job search, preparation of documents required by the Candidate User for employment and tracking the stages of their registration, direct communication with a potential employer (Employer User).

5.3. The Employer User uses any of the Resources to post information on vacancies, search for potential candidates and provide information to potential candidates (User Candidate), etc.

5.4. The Employer User agrees and confirms that in case of employment of the Candidate User and his work for a period of 14 (fourteen) or more calendar days for the Employer User vacancy posted on any of the Resources, the Employer User must pay the JobBro Administration fee in the amount determined by the relevant policy on the basis of the relevant bank account. The moment of the beginning of determination of the term of the beginning of work of the User-candidate on a certain vacancy of the User-employer is defined according to the information of one of the Resources by means of which such employment took place.

 

6. RIGHTS AND LIMITATIONS OF LIABILITY

6.1. In the case of provision / receipt of Services by Users, the Parties understand that one Party is the User-candidate and the other - the User-employer, and the above persons are the Parties in carrying out these actions, unless otherwise stated. The User understands and agrees that any of the Resources, JobBro Administration is not a Party to the said legal relationship, JobBro Administration does not provide such Services. The JobBro administration, in turn, is the sole provider of software to Users, both Candidate Users and Employer Users.

The JobBro Administration takes measures to ensure the reliability of the use of any of the Resources, however, the JobBro Administration cannot guarantee the completeness, truthfulness and accuracy of information about Users (both for Candidate Users and for Employer Users, including posted vacancies).

6.2. The User, using the capabilities of any of the Resources, at his own risk and receiving the Services accessed through any of the Resources, understands that the Resources are provided "as is" and in the form in which they are available for you, and the User is solely responsible for their actions, including in case of failure to meet any expectations of Users, losses, etc. Any of the Resources, JobBro Administration cannot guarantee to the User that the Services will meet the expectations of the User, as well as that the Users will fulfill their obligations to other Users in a proper manner.

6.3. The user understands that legal regulation is not always unambiguous, and may be accompanied by significant changes, which may also affect the employment market. By agreeing to the User Agreement, the User agrees that any of the Resources, the JobBro Administration is not responsible for the application of certain provisions of law, including when the Employer User provides and / or receives the Candidate User Services through any of the Resources, the JobBro Administration.

6.4. Problems of functioning of any of the Resources in exceptional may create certain difficulties in providing / receiving Services by the Parties, which may be due to overload of any of the Resources, technical difficulties in maintaining the performance of any of the Resources, technical capabilities of users, settings, access quality e Internet, etc., which may cause interruptions, delays in operation and the User agrees with the consequences that may be due to the above risks.

6.5. The User understands that there may be other risks associated with his use of any of the Resources ", which were not specified in this User Agreement, and also guarantees that he waives any claims to the JobBro Administration and / or any -which of the Resources in case of negative consequences is not the fault of the JobBro Administration and / or any of the Resources.

6.6. Use means that the Administration of JobBro and / or any of the Resources does not act in the interests of the User, does not act as an agent or advisor in relation to any Services provided on any of the Resources.

6.7. The User, using the capabilities of any of the Resources at his own risk, including in providing / receiving the Services, undertakes to be responsible, in particular, but not limited to: for their actions and / or omissions in the use of any of the Resources, including direct or indirect losses, lost profits, loss of income , loss of data, or costs incurred as a result of the User's use of any of the Resources, etc .; for storing any information provided through any of the Resources, including, but not limited to, login, password, email address, etc.

6.8. The JobBro Administration has the right, in its sole discretion, to deny access to any of the Resources to any Potential User without explanation, as well as in the cases stipulated in this User Agreement, its appendices, and to suspend the User's access to any which of the Resources, which the User is notified of the phone number / e-mail address specified by him when registering on any Resource.

JobBro Administration may not be liable for any actions, direct or indirect losses, lost profits, loss of income, any costs, costs of the User incurred as a result of the User's use of any of the Resources, in particular, in providing / receiving Services, access to which is provided by any of the Resources.

6.9. The JobBro Administration cannot guarantee uninterrupted access to any of the Resources, including in the event of force majeure. JobBro Administration is not responsible for the provision / receipt of the Services, access to which is provided by any of the Resources, properly, in the event of any errors, delays, failures, inconsistencies, as well as if the Service can not be provided, completed . Force majeure is, in particular, natural phenomena, fires, strikes, civil unrest, power outages, electricity, issuance of relevant legislation, Internet failures, terrorist acts, software malfunctions, security breaches or cyber attacks, etc.

6.10. The JobBro administration takes various measures to ensure the preservation of data provided by Users. However, the JobBro Administration cannot guarantee the complete security of the data provided by the Users when third parties access the User's data directly from the Users themselves or due to improper measures taken by the Users themselves to store their data.

6.11. The Administration of JobBro cannot guarantee the integrity of other Users who provide the Services. The JobBro Administration cannot guarantee the integrity of external sites, which the User may access through any of the Resources. By accessing external and third-party sites linked to by the User from any of the Resources, the User bears all risks associated with the use of such sites. In this regard, the Administration of JobBro informs about the need for careful use of such sites. In case of access to external and third-party sites accessed by the User through any of the Resources, JobBro Administration recommends reading the terms, rules, agreements of the above sites to ensure that there is no threat to the User when using these sites.

The User hereby agrees that the JobBro Administration may automatically send notifications regarding any of the Resources, individual services and / or partners of the JobBro for information and / or advertising purposes (including push notifications) to the Users' address using electronic communication channels. language (including e-mail). The user can opt out of such mailing by sending a message to the Support Service: [email protected]

6.12. The User understands that:

1) any of the Resources is provided to the User on a "as is" basis;

2) The JobBro Administration has the right to temporarily suspend the operation of any of the Resources both at the notice of the User and without notice at its own discretion, in case of preventive work (only for the time of preventive work), force majeure or in other cases, provided by the User Agreement or its Annexes;

3) JobBro Administration has the right to suspend access to the Personal Cabinet, in case of technical problems caused by software failure or other technical problems with the operation of any of the Resources, errors of the Personal Cabinet - in this case, after resolving these factors JobBro takes measures to restore the User's Personal Account;

4) the success of the provision / receipt of services, access to which is provided by any of the Resources, depends on many factors, in connection with which the Administration of JobBro can not respond and can not guarantee these actions in the desired conditions, terms and conditions. cannot guarantee the achievement of the result expected by the User, as the JobBro Administration is not a Party within the framework of the Service relationship, but only provides the opportunity by accessing the software for the Parties for such a relationship.

5) The JobBro Administration adheres to the policy of non-interference in the provision / receipt by Users of Services, access to which is provided by any of the Resources.

JobBro administration may post information, news, reveal events, post articles of various authorship, but this is not advice, advice, recommendation for the User (Users). Any decisions in the provision / receipt of the Services, access to which is provided through any of the Resources, are unambiguous and definite decisions of each individual User, made at its own discretion, for which the User is solely responsible.

 

7. PRIVACY POLICY

8. DISPUTE RESOLUTION PROCEDURE

8.1. Each of the Parties to the User Agreement has the right to make claims to the other Party.

8.2. If the User has a claim against the JobBro Administration and / or any of the Resources, the User will apply to the Support Service e-mail address: [email protected].

8.3. In case of claims in the JobBro Administration to the User, the JobBro Administration sends a claim via services to the mobile phone number or to the current e-mail address of the User. Information on the existence of a certain claim can be found in the User's Personal Account.

8.4. Upon receipt of the claim, the Party shall respond to the claim no later than 20 calendar days from the date of its receipt.

8.5 Claims sent by e-mail of the Parties shall be duplicated in writing to the legal and / or postal addresses of the Parties in order to ensure their proper receipt within 10 calendar days from the date of their sending by e-mail. In this case, the date of receipt of the claim is the date of receipt by the sender of the claim notice of reading the e-mail in which it is set out or an appendix to which is the claim.

8.6. If it is not possible to resolve the above disputes in a claim, any disputes, disagreements or claims arising out of and / or in connection with this User Agreement, the use of any of the Resources shall be finalized by a court.

 

9. APPLICATION OF LAW

9.1. This User Agreement is governed by and construed in accordance with the laws of the Republic of Poland.

 

10. INTELLECTUAL PROPERTY

10.1. Unless otherwise noted, all content presented on any of the Resources is the intellectual property of the JobBro Administration and is protected by copyright and other means of protection and enforcement of intellectual property rights, and the trademarks used may be protected as trademarks.

10.2. The software, text, images, graphics, data, materials, graphics, video and audio (hereinafter - the content) used on any of the Resources are the intellectual property of the JobBro Administration.

10.3. You may view, use copies of content from any of the Resources solely for personal informational non-commercial use, provided that you retain all technical means and protection of data materials, comply with the terms of this User Agreement, its Appendices and legal provisions. .

10.4. Trademarks and logos of the JobBro Administration used by any of the Resources are the intellectual property of the JobBro Administration and / or the rights holders to whom the JobBro Administration has granted the appropriate rights. All rights reserved.

10.5. Compilation, distribution, modification, use of any content posted on any of the Resources, partial use and processing of content and posting it on any other sites, other resources is prohibited without the prior written permission of the JobBro Administration to perform such actions .

10.6. The JobBro Administration reserves the right to use all legal remedies against actions that violate the rights of the JobBro Administration in terms of protection and copyright protection, other intellectual property rights.

10.7. If it is assumed that the content posted on any of the Resources infringes any and / or someone's intellectual property rights, the User may contact the Support Service: [email protected].

10.8. By registering on any of the Resources, the User agrees that any content posted on any of the Resources is protected by intellectual property rights, including copyright. In the case of using any of the Resources, these rights are not transferred or transferred to the User.

 

11. USE OF THE FORUM

11.1. JobBro Administration may provide the User (Potential User) with the opportunity to use the Forum.

11.2. At the same time, while using the Forum, the User is prohibited from:

1) insulting other Users, as well as representatives of the JobBro Administration (for violation of this paragraph may restrict the User's access to the Forum);

2) use profanity;

3) to express in order to incite ethnic hatred, propaganda of violence in any form, insults to the religious feelings of other users, etc .;

4) distribute links in any form;

5) advertise the goods and services of third parties;

6) flood, spam, communicate on topics not related to employment and any of the Resources;

7) provide false or misleading information, including about the JobBro Administration and / or about any of the Resources.

 

12. CHANGE OF TERMS OF THE AGREEMENT

12.1. The terms of this User Agreement and / or its Annexes may be unilaterally changed by the JobBro Administration without prior notice to the User. The new version of the User Agreement and / or its Annexes shall enter into force and be subject to observance from the moment of publication of the new version of the User Agreement and / or amended Annexes to it.

12.2. The JobBro Administration announces the entry into force of the new version of the User Agreement and / or amended Annexes to it by posting their texts on any of the Resources.

12.3. Before each use of any of the Resources, provision or receipt of Services using the Resources, the User undertakes to read the terms of the current version of the User Agreement and its Annexes.

12.4. The Administration of JobBro is not responsible for the fact that the User at any time was not acquainted (not acquainted) with the current version of the User Agreement and / or amended Annexes thereto.

12.5. Use of any of the Resources means the User's agreement with the version of the User's Agreement in force at the time of use of the Resources (or one of them).

12.6. If the User does not agree with the new version of the User Agreement and / or the amended Appendices to it, in this case the User ceases to use the Resources.

12.7. This User Agreement cannot be changed by the User as a whole or in a separate part.

 

13. FINAL PROVISIONS

13.1. This User Agreement is valid and binding for both the JobBro Administration and the User.

13.2. The User's performance of any actions on any of the Resources is a confirmation of the User's consent to comply in full with the User Agreement, other Annexes, which are integral parts of the User Agreement.

13.3. The headings and subheadings in this User Agreement are intended only to facilitate guidance on the terms of the document and should not be taken into account when interpreting any of the terms and conditions of this agreement.

13.4. The User Agreement, as well as the Annexes, which are integral parts of the User Agreement, have been compiled in the Ukrainian language. Despite the availability of available translations of the above documents in other languages, in case of conflict between the Ukrainian version of the above documents and any other translations into other languages, priority will be given to the Ukrainian version of these documents.

13.5. If any of the terms of this User Agreement is found to be illegal, invalid, unenforceable, in whole or in part, by any court of competent jurisdiction, such condition will not affect the legality, validity, performance of other terms of this User Agreement in full.

13.6. In the event of any inconsistency between this User Agreement, the Appendices, other documents, the pages of any of the Resources, the terms of this User Agreement shall prevail.
